Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARAVAN BREW AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage resulting from your use of our services
• Damages resulting from unauthorized access to or alteration of your data

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS GREATER.

Consequential Damages Exclusion

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these terms excludes or limits our liability for fraud, fraudulent misrepresentation, death, or personal injury caused by our negligence.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet service failures, or technical malfunctions.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Caravan Brew operates, without regard to its conflict of law provisions. Your use of our services may also be subject to other local, state, national, or international laws.

Jurisdiction

You agree that any legal action or proceeding arising out of or related to these terms or your use of our services shall be instituted in the courts having jurisdiction in our operating location. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Dispute Resolution

In the event of any dispute arising from these terms or your use of our services:

• We encourage you to contact us first to seek an informal resolution
• Both parties agree to negotiate in good faith to resolve disputes
• If informal resolution fails, disputes may be submitted to mediation before pursuing litigation
• Any litigation must be brought within one year of the cause of action arising

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

Waiver

Assignment

You may not assign or transfer these terms or your rights under them without our prior written consent. We may assign these terms without restriction. Any attempted assignment in violation of this section shall be null and void.
